1. Acceptance of Terms
By accessing or using Peep (https://peep-web-rosy.vercel.app), you agree to be bound by these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the site and you must discontinue use immediately.
2. Eligibility
The site is intended for users who are at least 18 years old. By using this site, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms of Service. Persons under the age of 18 are not permitted to use or register for the site.
3. Service Description
Peep is an Instagram monitoring tool that tracks publicly available data including follower changes, following activity, and stories. Our service uses AI classification to analyze Instagram connections and categorize them by type (male, female, brand). We provide anonymous story viewing and real-time notifications for tracked profiles. Peep does not host or control any Instagram content β all data originates from publicly available sources.
4. User Accounts
To use Peep, you must create an account by providing your email address and authentication details through Clerk. You are responsible for maintaining the confidentiality of your account and for restricting access to your devices. You agree to accept responsibility for all activities that occur under your account.
5. Payment and Refunds
Paid subscriptions (Starter and Premium) are billed weekly or monthly through Stripe. All sales are final. Refunds may be considered on a case-by-case basis only if no profiles have been added to your tracking dashboard and no features of the paid plan have been used. Once you add a profile to track, use the story viewer, or access any premium feature, the purchase is non-refundable under any circumstances. You acknowledge and agree that dissatisfaction with tracking results, the inability to find specific activity, or the lack of updates for a tracked profile does not constitute grounds for a refund. Peep monitors publicly available Instagram data, and results may vary depending on account visibility and activity. By completing a purchase, you accept that monitoring outcomes are not guaranteed and that no refund will be issued based on the quality, accuracy, or completeness of tracking results.
6. Intellectual Property Rights
Unless otherwise indicated, the site is our proprietary property and all source code, databases, functionality, software, website designs, text, and graphics on the site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us. The Content and the Marks are provided on the site "AS IS" for your information and personal use only. No part of the site may be copied, reproduced, republished, uploaded, posted, publicly displayed, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission.
7. Prohibited Uses
You agree not to use Peep to: - Harass, stalk, threaten, or intimidate any person - Monitor accounts for the purpose of causing harm or distress to the account holder - Use the service to make decisions about employment, insurance, or tenant screening - Engage in any activity that violates applicable local, state, national, or international law - Infringe upon the privacy rights of others - Access the site through automated or non-human means, whether through a bot, script, scraper, or otherwise - Attempt to reverse engineer, decompile, disassemble, or interfere with the operation of the service - Copy or adapt the site's software, including but not limited to HTML, JavaScript, or other code - Interfere with, disrupt, or create an undue burden on the site or the networks connected to the site
8. Third-Party Content Disclaimer
Peep does not create, upload, host, or control the Instagram content displayed in tracking results. All data is sourced from publicly available information. Peep makes no representations or warranties regarding the accuracy, completeness, or legality of third-party content. Peep is not responsible for any content that may be infringing, offensive, or otherwise objectionable that appears in tracking results.
9. Limitation of Liability
Peep provides tracking results on an "as is" and "as available" basis without warranties of any kind, whether express or implied. In no event shall Peep be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to damages for loss of profits, data, or other intangibles, even if Peep has been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the service in the past 12 months.
10. Indemnification
You agree to indemnify, defend, and hold harmless Peep, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: a) Your use or misuse of the service. b) Your violation of these Terms of Service. c) Any claim by a third party arising from your use of the tracking results. d) Your violation of any applicable law, regulation, or third-party right. This indemnification obligation shall survive the termination of your account and these Terms of Service.
11. Data Collection
Peep collects personal data, including your email address and payment information, as well as non-personal data such as web cookies and usage analytics. For more details on how we handle your data, please refer to our Privacy Policy.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United States.
13. Dispute Resolution
Any dispute arising from these Terms of Service or your use of the service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration, and judgment on the award may be entered in any court having jurisdiction.
14. Severability & Updates
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions. We may update these Terms of Service from time to time by updating the "Effective Date" at the top. Continued use of our services after any such changes constitutes your consent to such changes.
